Provincial Offences (POA)

The Provincial Offences Act (POA) is a procedural law for administering and prosecuting provincial offences, including offences created under municipal by-laws and minor federal offences designated as contraventions. The POA provisions govern all aspects from serving notice to a defendant to conducting trials, including sentencing and appeals.
The County of Prince Edward is responsible for processing charges, collecting fines and scheduling court trials. The County is also responsible for prosecuting most municipal by-law POA charges.
POA court is normally held at 67 King Street, Picton on the first and third Friday of each month. Please contact the Provincial Offences Clerk to confirm court dates.

Provincial Offences are:
Provincial Offences are non-criminal charges, primarily laid by the police, including those committed under the following:

Highway Traffic Act- such as speeding, careless driving, not wearing your seatbelt |
| • |
Compulsory Automobile Insurance Act- such as failing to surrender your Insurance Card or possessing a fake or invalid insurance card |
| • |
Liquour Licence Act- such as being intoxicated in a public place or selling alcohol to a minor |
| • |
Trespass to Property Act- such as entering premises when entry is prohibited or failing to leave premises after being directed to do so |
| • |
By-Laws- such as infractions under County of Prince Edward noise control, property standards, parking, and animal control |
Citizens issued provincial offences notices/tickets should read them carefully for a complete list of their options regarding pleading guilty or not guilty, trial and payment.

Ticket Information:
At the bottom of every ticket, there are two different amounts shown-the set fine on the left and the total payable, which includes the fine amount, the Victims Fine Surcharge and a $5.00 cost, on the right.
Victims Fine Surcharge:
Located to the right of the total payable amount on your ticket, the Victims Fine Surcharge is the difference between the set fine amount and the total payable amount. This surcharge is imposed by the provincial government and is added to every fine that is given out under the Provincial Offences Act. Proceeds from the surcharge will be used by the province to maintain and expand services to victims of crime.
